SPOT ON DTF
LEGAL NOTICE, TERMS & CONDITIONS OF SALE
Effective Date: 12 August 2026
These Terms & Conditions apply to all purchases, quotations, orders, printing, embroidery, artwork, customisation and related services provided by Spot On DTF (“Spot On DTF”, “we”, “us” or “our”).
By placing an order, paying a deposit or invoice, approving artwork, or instructing Spot On DTF to commence production, you (“the Customer”, “you” or “your”) acknowledge that you have read and accepted these Terms & Conditions.
Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable Australian legislation.
1. CUSTOM & PERSONALISED PRODUCTS
Many products supplied by Spot On DTF are custom-made, personalised or produced specifically to the Customer's requirements.
Because customised products are produced specifically for an order, Spot On DTF does not accept change-of-mind cancellations, returns or exchanges once production has commenced, unless otherwise agreed by Spot On DTF or where required by law.
This does not affect any rights the Customer may have under the Australian Consumer Law.
2. CUSTOMER-SUPPLIED ARTWORK & INFORMATION
The Customer is solely responsible for ensuring that all artwork, logos, photographs, text, names, numbers, spelling, colours, measurements and other information supplied to Spot On DTF is correct and suitable for production.
Spot On DTF is entitled to rely upon the artwork and information supplied or approved by the Customer.
Spot On DTF will not be responsible for errors contained in artwork or information supplied by the Customer, including but not limited to:

spelling or grammatical errors;
-
incorrect names or numbers;
-
incorrect logos;
-
incorrect colours or colour references;
-
incorrect sizing or positioning;
-
low-resolution or poor-quality artwork; or
-
artwork supplied in an unsuitable format.
The Customer remains responsible for checking the final artwork before production.
3. ARTWORK APPROVAL
Where Spot On DTF provides a digital proof, mock-up or artwork for approval, the Customer is responsible for carefully checking the proof before providing approval.
Approval may be provided by email, text message, social media message, verbal confirmation, payment, written confirmation or any other communication reasonably indicating acceptance.
Once artwork has been approved, Spot On DTF may proceed to production.
Any subsequent request to alter approved artwork may result in additional costs, delays or the inability to make changes if production has already commenced.
4. COLOUR ACCURACY & PRINTING VARIATIONS
The Customer acknowledges that exact colour reproduction cannot always be guaranteed.
Colours may vary due to differences between:
-
computer and mobile screens;
-
digital artwork and physical materials;
-
garment colours and fabric composition;
-
DTF printing processes;
-
printer, ink and film characteristics;
-
heat-press conditions; and
-
different production batches.
Fluorescent, neon, highly saturated, metallic and specialty colours may be particularly difficult to reproduce accurately through DTF printing.
Spot On DTF will make reasonable efforts to achieve the closest practical result to the approved artwork or requested colour.
A minor or reasonable colour variation that results from the limitations of the printing process will not, by itself, constitute a manufacturing defect.
Where an exact colour match is critical, the Customer should request a physical sample or colour test before production, where available.
5. GARMENT VARIATIONS
Garments may have minor variations in colour, measurements, stitching, fabric texture, fit or construction between sizes, batches and manufacturers.
Such variations are inherent to commercially manufactured garments and will not automatically constitute a defect.
Spot On DTF is not responsible for manufacturer variations that do not materially affect the intended use of the garment.
6. CUSTOMER-SUPPLIED GARMENTS
Where the Customer supplies garments or other materials for printing or embroidery, the Customer accepts responsibility for ensuring that the supplied items are suitable for the requested application.
Spot On DTF is not responsible for:
-
pre-existing damage or defects;
-
hidden weaknesses in the fabric;
-
colour bleeding or dye migration;
-
shrinkage;
-
fabric reactions;
-
unsuitable materials;
-
manufacturer defects; or
-
damage resulting from characteristics of the supplied garment or material.
Spot On DTF will exercise reasonable care when handling Customer-supplied items.
7. DEPOSITS & PAYMENT
Unless otherwise agreed in writing, a 50% deposit may be required before production commences.
The remaining balance is payable when the order is completed and before delivery or collection.
Spot On DTF may delay production, delivery or collection where an agreed payment has not been received.
Any deposit or prepayment will be applied toward the agreed order price. If an order is cancelled by the Customer after Spot On DTF has incurred costs or commenced work, Spot On DTF may retain or recover amounts reasonably attributable to work performed, materials purchased, production costs or other losses reasonably incurred, subject to applicable law.
8. ORDER CHANGES & CANCELLATIONS
The Customer must notify Spot On DTF of any requested changes or cancellation as soon as possible.
Once artwork has been approved, materials ordered or production commenced, cancellation or changes may no longer be possible.
Where a cancellation is accepted, the Customer may be responsible for reasonable costs already incurred by Spot On DTF in connection with the order.
Any cancellation charge will be based on reasonable costs or losses incurred and will not operate to exclude any rights the Customer has under the ACL.
9. PRODUCTION TIMEFRAMES
Any production or delivery timeframe provided by Spot On DTF is an estimate unless a specific timeframe has been expressly agreed in writing.
Timeframes may be affected by:

supplier delays;
-
garment availability;
-
artwork changes;
-
customer approval delays;
-
equipment or production issues;
-
courier delays;
-
public holidays; or
-
circumstances outside Spot On DTF's reasonable control.
Spot On DTF will make reasonable efforts to complete orders within the estimated timeframe.
10. DELIVERY & COLLECTION
The Customer is responsible for providing accurate delivery information.
Spot On DTF is not responsible for delays, additional delivery charges or failed deliveries resulting from incorrect, incomplete or outdated information supplied by the Customer.
Where an order is ready for collection, the Customer is responsible for collecting it within a reasonable period.
Any additional storage, redelivery or handling costs caused by unreasonable collection delays may be charged where reasonable and agreed or permitted by law.
11. INSPECTION OF ORDERS
Customers should inspect their order as soon as reasonably possible after receiving or collecting it.
If the Customer believes an order contains an error, defect, damage or other problem, they should contact Spot On DTF promptly and provide photographs and relevant order details where requested.
Prompt notification allows Spot On DTF to investigate and, where appropriate, provide a remedy.
Nothing in this clause limits any rights available under the Australian Consumer Law.
12. FAULTS, ERRORS & CONSUMER GUARANTEES
Spot On DTF aims to provide products and services with due care and skill and in accordance with the agreed order specifications.
Where a product or service fails to meet an applicable consumer guarantee, Spot On DTF will provide the remedy required by law.
Depending on the circumstances, a remedy may include repair, replacement, refund or compensation.
The Customer must provide Spot On DTF with a reasonable opportunity to inspect and assess an alleged fault or production issue before an appropriate remedy is determined, except where the law provides otherwise.
Nothing in these Terms & Conditions limits or removes the Customer's rights under the Australian Consumer Law.
13. CUSTOMER-APPROVED ARTWORK ERRORS
Where an error exists in artwork supplied or approved by the Customer, Spot On DTF will not be responsible for reproducing that error.
For example, if a Customer approves artwork containing an incorrect business name, spelling, telephone number, logo or other information, the Customer accepts responsibility for that approved content.
This clause does not apply where the error was introduced solely by Spot On DTF after receiving correct artwork or instructions from the Customer.
14. REPRINTS & REMEDIES
Where an issue is determined to be a Spot On DTF production error, Spot On DTF may, where appropriate and permitted by law, offer a reasonable remedy such as:
-
correction;
-
reprint;
-
replacement;
-
refund; or
-
another mutually agreed solution.
The appropriate remedy will depend on the nature and severity of the issue and the Customer's rights under the ACL.
Spot On DTF is not required to provide a remedy for an issue caused solely by Customer-supplied artwork, incorrect Customer instructions, misuse, ordinary wear and tear, accidental damage or other circumstances for which Spot On DTF is not responsible.
15. RETURNS & CHANGE OF MIND
Spot On DTF does not provide change-of-mind refunds, exchanges or returns for personalised or custom-made products once production has commenced, unless otherwise agreed.
A Customer who simply changes their mind, orders the wrong size, supplies incorrect information or decides they no longer want a custom product is generally not entitled to a refund solely for that reason.
This policy does not limit any rights the Customer has where a product or service fails to meet an applicable consumer guarantee.
16. CHARGEBACKS & PAYMENT DISPUTES
Before initiating a payment dispute or chargeback, the Customer is requested to contact Spot On DTF and provide an opportunity to investigate and resolve the issue.
Where a payment is disputed through a bank, card provider, PayPal or other payment service, Spot On DTF may provide relevant documentation demonstrating the order, payment, artwork approval, communications, production and delivery or collection.
Nothing in this clause prevents a Customer from exercising any lawful rights available through their payment provider or under Australian law.
17. INTELLECTUAL PROPERTY & CUSTOMER AUTHORITY
The Customer warrants that they have the necessary rights, licences and permissions to provide any artwork, logo, photograph, trademark, design or other material supplied to Spot On DTF.
The Customer authorises Spot On DTF to reproduce that material solely for the purpose of fulfilling the Customer's order.
The Customer is responsible for any claim arising from the Customer's unauthorised use of third-party intellectual property.
Spot On DTF may refuse to reproduce artwork where it reasonably believes doing so may infringe a third party's rights or breach applicable law.
18. USE OF CUSTOMER WORK
Unless otherwise agreed, Spot On DTF may retain copies of completed artwork and order information for business records, quality control and order-history purposes.
Spot On DTF will not publicly display a Customer's artwork, logo, garments or completed order for promotional purposes where the Customer has expressly requested in writing that their order not be used for promotional purposes.
19. WEBSITE & PRODUCT INFORMATION
Spot On DTF makes reasonable efforts to ensure that product descriptions, images, prices, colours and other information displayed on its website are accurate.
However, photographs and digital images may not represent the exact colour or appearance of the physical product.
Spot On DTF reserves the right to correct genuine pricing, description or availability errors before an order is accepted or production commences.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Spot On DTF will not be liable for loss or damage arising from matters outside its reasonable control or from information, artwork, materials or instructions supplied incorrectly by the Customer.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited under Australian law, including applicable rights and remedies under the Australian Consumer Law.
21. EVENTS OUTSIDE OUR REASONABLE CONTROL
Spot On DTF will not be responsible for delays or failure to perform caused by circumstances outside its reasonable control, including significant supplier failures, material shortages, equipment failures, natural disasters, extreme weather, transport disruptions, government restrictions, industrial action or other unforeseen events.
Where such circumstances occur, Spot On DTF will take reasonable steps to minimise the impact and complete the order when reasonably practicable.
22. BUSINESS CUSTOMERS
Where an order is placed by a business for business purposes, the Customer acknowledges that different provisions of the Australian Consumer Law may apply depending on the nature and value of the transaction.
Nothing in these Terms & Conditions is intended to incorrectly exclude any statutory rights that apply to a business Customer.
23. PRIVACY
Personal information supplied to Spot On DTF will be handled in accordance with our applicable Privacy Policy and Australian privacy requirements.
Customers should not provide unnecessary personal information when placing an order.
24. DISPUTE RESOLUTION
If a Customer has a concern regarding an order, the Customer should first contact Spot On DTF and provide details of the issue.
Spot On DTF will make reasonable efforts to investigate and resolve genuine disputes promptly and fairly.
Nothing in this clause prevents either party from exercising rights available under Australian law or contacting an appropriate consumer protection or dispute resolution body.
25. GOVERNING LAW
These Terms & Conditions are governed by the laws applicable in Victoria, Australia.
Any dispute will be subject to the jurisdiction of the applicable courts and tribunals of Victoria and Australia.
26. ACCEPTANCE OF TERMS
By placing an order, making payment, approving artwork, responding to a proof, or instructing Spot On DTF to commence production, the Customer acknowledges that these Terms & Conditions have been made available to them and agrees to be bound by them to the extent permitted by law.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate.
These Terms & Conditions should be read together with any quotation, invoice, written order confirmation, artwork approval or other written agreement applying to the particular order.
